Justin was this week’s speaker at the WBG breakfast meeting, bringing some momentous news for both the group and many people in Tenterden who have used Nelson McLean for legal work relating to house purchases/sales.
Following a recent complaint made to the regulatory body, the CPC, regarding Nelson McLean, it came to light that Malcolm McLean had been doing some professional work without charge for a friend. Due to the nature of the arrangement, little had been kept in the way of records, and as Malcolm is the only solicitor in the firm, he is Head of Legal Practice, Head of Finance and Administration, and Money Laundering Reporting Officer. The buck stops with him on all such matters.
Whilst Nelson McLean are confident the claim is without merit, the investigation has been severely hampered by the lack of records, and has caused the provider of Professional Indemnity Insurance to refuse cover until the matter is resolved. Something which does not seem imminent as the CPC’s initial findings have only just been issued.
As the firm cannot conduct business without insurance, the difficult decision to cease trading had to be taken. Clients have been directed to other conveyancing firms, and Anne has decided to work part-time providing admin support to Justin at Nelsons Legal. Justin too is to start working part-time as he nears retirement.
